Electronic-documents and ways to challenge their validity - a comparative study
Abstract
Electronic-documents( E-documents) are defined as documents that contain integrated, stored, sent or received data that archived electronically or by any other similar means including email, telegram, telex or telecopy, associated with a certified electrostatic signature. Generally, the way to challenge the validity of E-documents are denial, lack of knowledge and electronic forgery. However, it is argued that evidentiary wight of E-documents does not subject to the general rules of evidence law due to the different nature of the documents. This paper highlights the need amend the electronic-signature law and the electronic- transactions law with special texts that accommodate these.
