The Separation between Disciplinary and Criminal Offenses and its Interaction

Abstract

Disciplinary procedures may overlap with criminal procedures. However, the separation must be recognized between the two systems as criminal charges are different from disciplinary offences. Despite the fact that the general principles of criminal law are applicable to disciplinary sanctions such as the permissibility principle, the criminal offences interact with disciplinary when they aim to protect the criminal justice system.
