The Impact of the Coronavirus Pandemic on the Limitation Periods -A Comparative Study-
Abstract
A limitation period is deadlines set by law for bringing legal action or procedure, and if the limitation period expired then the claim is statute-barred. This is because once the limitation period has started, the running of time cannot be suspended. However, litigation procedures may interrupt by force majeure , an event that is unforeseeable and cannot be prevented. More recently, the closure of court premises was declared, and hearings and procedures were postponed or cancelled in response to the coronavirus crisis and to contain the pandemic. The aim of this paper is to investigate the impacts of the pandemic on limitation periods during the pandemic.
