General formal restrictions for general administrative sanctions
Abstract
Legislators may empower the competent administrative authority to impose general administrative sanctions on those who violate laws and regulations. However, they also provide protections for individuals subject to these sanctions by placing restrictions on the administration's authority. These general restrictions, such as the requirement for reasoning and the right of defense, should be embedded in the legislative framework governing administrative actions. Reasoning allows the offender to understand the grounds for the penalty, and it is a formal component of administrative decisions, required when stipulated by the legislator or when related to general administrative sanctions. The right of defense, a fundamental constitutional principle found in most global constitutions, enables the violator to protect their interests and assert their rights through legal channels, including notification of the violation and administrative investigation when necessary.
