الدفع بعدم الاختصاص المکانی فی الدعوى المدنیة –دراسة مقارنة-

الملخص
یعتبر الدفع بعدم الاختصاص المکانی وسیلة دفاعیة تتقرر للمدعى علیه ومن فی حکمه أو من ینص القانون على حقه فی استعمال هذه الوسیلة الاجرائیة، بقصد المحافظة على قواعد الاختصاص القضائی. وهی صورة من صور الدفع الاجرائی و یعتبر هذا الدفع من أهم المسائل التی تدور فی الوسط القضائی التی یجب على الخصوم ، وکافة أطراف العملیة القضائیة فهمها على الوجه المطلوب. وفی هذا البحث دراسة تأصیلیة فقهیة لهذه المسألة فی القانون العراقی وفی القوانین المقارنة محل الدراسة، وضحت فیه المراد بالدفع بعدم الاختصاص المکانی و قواعد الاختصاص المکانی. وکذلک تناولت فیها أحکام هذا الدفع فی الدعوى الاعتیادیة و تطرقت إلى أحکامه أیضاً فی الدعوى الاعتراضیة. واشتمل هذا البحث المتواضع على مبحثین ، تناولت فی المبحث الأول ماهیة الدفع بعدم الاختصاص المکانی ضمن مطلبین الأول هو التعریف بالدفع بعدم الاختصاص المکانی، والثانی فی قواعد الاختصاص المکانی. أما فی المبحث الثانی فقد انتقلت إلى دراسة أحکام الدفع بعدم الاختصاص المکانی حیث اشتمل هذا المبحث على مطلبین الأول فی أحکام الدفع بعدم الاختصاص المکانی فی الدعوى الاعتیادیة ، والثانی فی أحکام الدفع بعدم الاختصاص المکانی فی الدعوى الاعتراضیة. بالإضافة إلى المقدمة والخاتمة التی تضمنت أهم النتائج و التوصیات.
